A recent Court of Appeal decision in which Kelly Ann Maw and Tessa Latowsky were counsel has generated interest in the legal community and was featured in the July 2024 edition of the Take Five Newsletter. Take Five is a monthly publication summarizing the top five most interesting cases emerging from the BC Court of Appeal. Kelly Ann and Tessa provide their comments on the Court’s decision in Nourifard v Emadzadeh, 2024 BCCA 240, in this month’s issue available here. Of particular note in the Court’s decision are the clarifications regarding the limits of a judge’s ability to consider evidence in a Rule 9-6 (summary judgment) application and the Court’s cautions on changing positions in the Supreme Court and in the Court of Appeal.
